July 2025 NC REALTOR® Forms Changes

The North Carolina Assocation of REALTORS® (NCAR) rolled out key changes to several forms, effective July 1, 2025.

Below is a condensed reference for North Carolina brokers. Only substantive changes are listed; layout tweaks and renaming are omitted. Updated forms are available now directly from the NCAR or through your preferred Forms Vendor.

Residential Forms

Form

Key changes & practical impact

2‑T Offer to Purchase & Contract

• Escrow agents may release earnest money when no dispute exists; disputes still follow Form 355 + one‑banking‑day rule.


• Price, seller concessions (now dollar and % blanks), DD period, and settlement date all move to page 1.


• Red text replaces warning boxes: contract is strictly as‑is, has no loan / appraisal contingency, and “other‑property” line does not create a sale contingency.


• Buyer‑money remedy paragraph relocated under “Buyer Obligations.”


• Two HOA lines clearly labeled Association # 1 / # 2 to stop duplicates.


• Seller affidavit paragraph added so closing attorneys can insure title despite the new e‑recording system.

2‑T Guidelines

Rewritten; adds four‑question fixture test, notes keys seldom handed over until deed records, and adds guidance for solar panel liens.

2A4‑T FHA/VA Addendum

VA paragraph now quotes the exact VA‑required wording .

Smart‑home addenda (2A7‑T, 2A8‑T, 2A11‑T) & Possession Forms

Sellers (or seller‑tenants) must unlink and wipe cameras, locks, thermostats before buyer takes possession .

4‑T Agreement to Amend

New boxes to add/remove a party and to shorten / extend the DD period .

101 Exclusive Right‑to‑Sell

“Other Fees” can now hold a fee schedule; “Total Cost” is optional for variable‑rate plans; entity‑transfer language restored .

201 Exclusive Buyer Agency

Checkbox for builder/seller bonuses (state the cap), plus clear early‑termination language .

Termination suite (350‑T, 351‑T, 390‑T)

Six older notices trimmed to three one‑pagers (buyer unilateral, seller unilateral, mutual). Buyer notice now lets them concede the EMD to the seller if they’re past DD.

710‑T Agency Amendment

Single sheet updates firm fee, co‑op comp, any dual‑agency model, listing price—complete with amendment‑number box.

725 Statement of Agency & Compensation

One‑page proof of your agency status & exact fee—handy for builders, lenders—without revealing the full agreement.

110 Seller Estimated Net Sheet

Re‑designed to one page; now shows pre‑marketing costs, liens, closing expenses and calculates net under three scenarios.

170 Seller Move‑Out Checklist

Gives clients a step‑by‑step on disconnecting utilities & smart devices; reference in your listing packet.

Clarifies buyer & seller are not parties; no client signature needed .

542 Commission Split – Lease

Checkbox to compute commission on base rent only; same non‑party clarification .

580‑T Commercial Purchase Contract

First page re‑flowed—price, EM, DD fee, timing now together (content unchanged).


Property‑Management Forms

410‑T Residential Rental Contract

Abandonment established if tenant removes possessions or turns in keys.


• Tenant must send a written repair request before alleging landlord default .


Fast reference

  • Effective date: use new forms for contracts written on or after July 1, 2025 (old versions allowed only until Aug 30, 2025).

  • Three dual‑agency choices (same agent, two‑agent, designated) must be selected up front—use Form 710 if that shifts.

  • Smart‑device wipe is now contractual—add it to closing checklists.

  • Escrow myth busted: no written release needed when the parties don’t dispute the money.

  • Form 725 is your shield—show fees to builders/lenders without handing over the whole agency agreement.
